Artist Terms and Conditions
These terms and conditions form a legally binding agreement between you and Platinumgallery.co.uk meaning Platinum Gallery, the supplier of the Service. Your statutory rights are not affected.

Being accepted as an artist
Your application includes your acceptance of these terms and conditions. You warrant that all information supplied to Platinum Gallery is accurate, and up to date. You warrant that you are representing yourself and not registering on behalf of someone else. You agree to have your artwork and descriptive information displayed on Platinumgallery.co.uk. You will inform Platinum Gallery if the information stored by Platinumgallery.co.uk including name, address and contact details, pricing of artworks, and the Sold status of artworks changes. . Registration is free; you are able to build your very own art gallery online with us without paying a penny. Platinum Gallery reserves the right to accept or decline your application to market any artwork through Platinumgallery.co.uk
Marketing artwork elsewhere
You may simultaneously market your artwork through other channels as well as marketing through Platinumgallery.co.uk, providing this does not affect your ability to deliver the artwork to the customer within the specified time. You must inform Platinumgallery.co.uk immediately if your artwork is sold through another channel so that we may remove it from the site.
Artwork images
You must supply high-quality digital images of each artwork you wish to sell through Platinumgallery.co.uk: The Images must be in JPEG format. The images should show the entire canvas and frame (if framed). For best image upload results we recommend that you upload images which are between 900 and 1100 pixels on their longest side. Artworks which possess two or three images showing different angles of the artwork usually sell far quicker than artworks with only the one image.
Pricing artwork
You will set the price which your artwork should be sold for. This price must be inclusive of VAT (if applicable), your delivery costs and Platinum Gallery commission which is 15% on each sale. Platinum Gallery will notify you in advance of the commission rate applicable to you. Once accepted you agree to sell the artwork at the accepted price. Once listed you may not raise the price of an artwork without the permission of Platinum Gallery. As from the 1st October 2008 Platinum Gallery will take 20% commission on any new artwork that is submitted. PayPal processing fees will also be deducted from the final payment to the artist.
Your account and security
If a particular Service requires you to open an account you will be required to complete the registration process by providing certain information and registering a username and password for use with that Service. You are responsible for maintaining the confidentiality of the username and password and also for all activities which take place under your account. You must immediately notify us of any unauthorised use of your password or account or any other breach of security. In no event will PlatinumGallery.co.uk be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password. You may not use another person’s account at any time, without the express permission of the account holder.
If you have forgotten your username and/or password please email Matt (Our Artist Liaison Manager) at info@PlatinumGallery.co.uk and you will be notified of your username and password via a secure email.
Packaging and delivery of artwork
As an accepted artist you are responsible and liable for costs of all materials, packaging and delivery costs. These costs cannot be reclaimed from Platinum Gallery and should be taken into account when pricing your artwork.
You will ensure that artworks are securely packaged and labelled for delivery to the customer. Platinum Gallery will not accept claims for reimbursement in the event of damage to artworks through insufficient packaging.
You will not meaningfully include any contact details in the packaging that would enable the customer to deal directly with you.
The artwork must arrive with the customer within the time period you have advertised in your listing. Should you become aware of any reason why an artwork that has been ordered from you may not be received by the customer within this period, you must notify Platinum Gallery immediately of the reason for and expected length of the delay. Platinum Gallery will attempt to contact the customer and in some cases may offer a refund to the Customer resulting in the cancellation of the order from you.
Payment for artworks
Should your artwork be sold we will raise a purchase invoice for the price. The invoice will be paid by Platinum Gallery no sooner than 14 days after Platinum Gallery have confirmed delivery of the artwork(s) to the customer. Payment will be made by cheque or bank transfer. You will not correspond directly with the customer. In the event of a refund claim we will release your details to the customer for them to return the artworks to you.
Money back guarantee
You accept that the customer may return the artwork(s) within 14 days of receipt, and this will constitute cancellation of the order. Platinum Gallery will not accept liability for your delivery expenses in this instance. All correspondence with the Customer regarding returns and refunds will be through Platinum Gallery.
Being accepted as a Top Artist
Once registered, artists have the option of paying a one off fixed fee of £15 to become a “Top Artist” for six months or £20 to become a member of the list for a year. The Top Artist List appears on the homepage at PlatinumGallery.co.uk which means your free online gallery is more visible on the site. This list is limited to only 25 spaces. Newly registered Top Artists are added to the bottom of the list and as other artist’s registrations run out they move further towards the top of the list. Payments are non-refundable. PlatinumGallery.co.uk reserves the right to decline any artist from featuring on this list for any reason, without notice.
Copyright Law
You warrant that all work sold through the Site is free of any copyright restrictions or intellectual property disputes. You warrant the work is yours to sell.
The copyright in the artwork will remain with you even after ownership of the artwork is transferred to the buyer.
All content included on the website, such as text, graphics, logos, button icons, images, audio clips, video clips, PDF documents and software is the property of Platinum Gallery or its content suppliers and is protected by United Kingdom and international copyright and database right laws.
Service availability
While PlatinumGallery.co.uk shall endeavor to make this site available at all times, we will not be liable if, for any reason, the site is unavailable for any period of time. Access to this site may be suspended at any time without prior notice being given.
Our Customer relationship
You agree that the business relationship between the customer and Platinum Gallery is entirely through Platinum Gallery. You will not approach the customer directly or correspond with the customer in any way, except with express written authorisation from Platinum Gallery. You will not sell directly to the customer or allow a direct relationship to develop between you and the customer that could be detrimental to Platinum Gallery. You will not pass your contact details to the customer, including in artwork packaging. All correspondence with the customer shall take place through Platinum Gallery. We shall provide each artist with a feedback sheet on each sale. This form includes feedback comments from the customer so that the service and artwork available are kept at the highest standards possible. In the event of a return or damaged good claim, we will release your details to the Customer.
Termination
We have the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior notice and you agree that we shall not be liable to you or any third party for any termination of your access to the Website/Services.
Changes to the Terms & Conditions
We reserve the right to change the Terms & Conditions from time to time, and post a new version on our website. The new version will take effect from the time of posting on the site.
Disclaimer
You agree to defend, indemnify, and hold harmless Platinum Gallery, its officers, directors, employees, agents, and third parties, from your use of the service, including any violation of these rules.
PlatinumGallery.co.uk has tried to ensure that the contents and information it provides on its web sites is accurate at the time of posting. Unfortunately it cannot guarantee the accuracy of contents or information contained in its pages and any person using information contained in them does so entirely at their own risk
The colour displayed on the website may vary slightly according to an individual users monitor settings and graphics card.
PlatinumGallery.co.uk may have links to other websites and is not responsible for the contents, nor does it warrant the accuracy or reliability of any linked website.
Platinum Gallery provides this service on an “as-is” basis without warranty of any kind including the implied warranty of satisfactory quality. This Agreement is entered into in United Kingdom and shall be governed by, and shall be constructed in accordance with British Law. The courts of England and Wales shall have jurisdiction to hear and determine any cost, action or proceedings, and to settle any disputes which may arise out of or in connection with these rules and you irrevocably submit to the jurisdiction of such courts.
Using the service constitutes acceptance of these rules.
